BECAUSE YOU ASKED . . .

. . . I will tell you what I think about this scenario:

DECORATED ARMY PHYSICIAN REFUSES ALL MILITARY ORDERS BECAUSE PRESIDENT REFUSES TO DOCUMENT HIS CONSTITUTIONAL ELIGIBILITY

Court Martial Likely, Legal Defense Fund Established

Washington, D.C., March 30, 2010. “I am today compelled to make the distasteful choice to invite my own court martial, in pursuit of the truth about the president’s eligibility under the constitution to hold office”, said active duty Army Lt. Col. Terrence Lakin. The American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, immediately announced it has set up a legal defense fund and will provide Lt. Col. Lakin with a top-flight defense team. Details are available on the foundation’s website, www.safeguardourconstitution.com.

Bottom Line, STORMBRINGER:

This guy is an idiot on many different levels; I say he's a wingnut and a prime candidate for the tinfoil hat brigade.

For starters, when you don the war suit, you take an oath to ". . . uphold the Constitution against all enemies, foreign and domestic."

It doesn't say the President - although admittedly he IS the Commander-in-Chief - it says the Constitution, and the officers legally appointed over you. It certainly doesn't say you've been granted the legal authority and wisdom of the Supreme Court to take Constitutional matters into your own hands.

The point is not whether or not Barack Obama was born in the United States, or Kenya, or Indonesia, or if he was born on the Moon. I myself am curious as to what Obama's original birth certificate looks like, but at this point in time it simply doesn't matter anymore - the man was sworn in by Chief Justice of the United States John G. Roberts with his hand on George Washington's Bible, and that makes him President of the United States - until determined otherwise by authorities a LOT higher than a whacked out lieutenant colonel who obviously has WAY too much time on his hands.

First of all, don't confuse this man's rank with any kind of military credential - they throw rank at medical officers just to make them stick around. Bear in mind that Hasan dude who shot up Fort Hood was a field grade officer, but if he was in any kind of regular military organization they would have run him out on a rail for the kind of things he was saying - I've seen it done for a lot less.

Another military doc with too much time on his hands is this candidate for Code Pink Poster Boy. Like, who gives a rat's rear end what his sexuality is? (As long as he keeps it in the closet - where it belongs - that is.) In an ongoing series of posts at Frum Forum this shrink-with-a-kink establishes his worthlessness right up front by explaining how he wandered around a combat zone, even took place on dismounted patrols - but was somehow unable to get himself issued a rifle.

One of the truisms I gathered during twenty-five years in combat arms units is that medical officers have less leadership capabilities than chaplains.

Let's get back to LTC Terrence Lakin - I'm trying to follow the man's line of reasoning here: so we've got a bunch of conflicting info out there flying all over the Internet about Barack Obama's place of birth. Based on this hyperbole, this officer is willing to throw away his position, all pay and privileges associated with his rank, and risk going to Leavenworth - NOT a nice place - over glorified "Rumor Control". Sorry, does not pass the common sense smell test.

Now a lot of people have been digging deep for proof one way or the other, and if there was a shred of evidence Obama was not qualified to be President, his many enemies would have unearthed it by now.

Our system has survived crisis for over two hundred and thirty years; we have mechanisms in place to deal with situations like this, and part of the reason our system works is it allows for the Wheels of Justice to turn at their own speed - which is second gear, at best. I do not endorse radicalism or desperate acts based on impassioned revolutionary rhetoric. A basic tenant of the Philosophy of STORMBRINGER is coolness under fire; which is defined as keeping your head when everybody around you is losing theirs.

Like my mentor Doc Cheasty said; "You take the King's schilling, you gotta do what the Man says. You don't like it, move out . . ."

There are all sorts of ways of getting out of the military if you don't want to be there. This guy chose a particularly spectacular method of disengagement . . .

Hey! Lets not insult the chaplains! :)

  3. He's bringing a lot of negative attention to the fine officers and soldiers serving and putting their lives on the line. Those close to him ought to discourage him, yank him off his pedestal.
Back when I went through, he would be candidate for a blanket party. "I dunno, Sarge, guess he fell down the stairs or something".

  4. The reason that his story is making news is that none of us regular citizens have 'standing' to question Obama's eligibility according to the many lawsuits that Obama has spend ~$12M on so far with his CAIR lawyers.
    Military has standing.
And since there is NO government background checks on Senators or POTUS allowed by law, the media and public were the Constitution's safety net to expose any scandal upfront of elections.
Unfortunately, the marketing of O and the aggressive dismissal of all objectors as Racist precluded that from happening.

  5. Constitutional requirements have not been met. But nobody has standing according to media and courts and voting. That's three of ther four boxes - which leaves the other one.

When reason fails, and voting fails, and courts fail - Then Honduras had the balls to do the right thing.

  6. I did not swear to obey orders of those appointed over me! (but read on…)

I disagree with Dr. Lakins’ tactics in this matter – because I think it a futile gesture. But I admire his moral courage. And yes, it is all about standing.

However - One minor quibble… The Oath sworn by commissioned officers does not include the stricture to obey the orders of “officers legally appointed over you.” My oath is to “support and defend the Constitution of the United States against all enemies, foreign and domestic.” Nothing more, nothing less.

I did not swear an oath to the government, neither to the administration, nor even to the military hierarchy. Obviously I have an obligation, as a dutiful soldier and bearing the commission of Congress, to obey lawful orders, to carry out my duties, to “bear true faith and allegiance”, etc – unless and until such orders conflict with my duty to support and defend the Constitution.

Now the problem of course is how one ‘implements’ that requirement. What does “upholding” the Constitution require? We all know what to do when in receipt of “illegal” orders which involve a war crime; but what of an unconstitutional act?

The Military has no answer to that; we do not discuss it; we do not train it – as we do the Law of War scenarios.

In LTC (Dr.) Lakins’ case, I think the trouble is that, while he has standing and great moral courage in questioning Mr. Obama’s bona fides, he doesn’t have proximate cause for rejecting just any and every order, whether from the President or the rest of the military hierarchy. Obama’s qualifications may (and should) objectively be questioned, but refusing any and every order - just because - is not a reasonable response.

But he does have standing and I wish him well.

Commissioned Officer’s Oath: I, [name], do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.[1]
